Terms of Service
Effective July 13, 2026
1. The service and who these terms bind
This platform ("the Service") provides practice testing, diagnostics, and progress analytics to schools and tutoring organizations ("Schools") and their students. It is operated by James Brandon Mathews ("the Operator"). By creating accounts for its staff and students, a School agrees to these terms on behalf of its users. Students and staff use the Service under their School's agreement.
2. Accounts
- Accounts are created and administered by Schools (or by the Operator on a School's behalf). Credentials are personal — don't share accounts.
- Schools are responsible for the accuracy of the rosters they upload and for deactivating accounts of departed staff and students.
- The Operator may suspend accounts that compromise the Service's security or integrity.
3. Acceptable use
Users may not:
- copy, scrape, redistribute, or republish test content, which is licensed for use within the Service only;
- attempt to access other users' data, probe or overload the Service, or circumvent its access controls;
- use another person's account or misrepresent test results.
Academic-integrity features (such as timing and focus tracking during proctored tests) are described in the Children's Privacy Policy.
4. Student data and privacy
Student personal information is collected and used only as described in the Children's Privacy Policy, which is part of these terms. Schools consent to that collection on parents' behalf for educational purposes, as COPPA permits, and are responsible for honoring parents' review and deletion requests using the Service's built-in tools or by contacting the Operator.
5. Content ownership
- The Service, its software, and the test content it provides remain the property of the Operator or its licensors.
- Content a School uploads (its own tests, rosters, branding) remains the School's; the School grants the Operator the license needed to host and display it within the Service.
- Scores, bands, and diagnostic outputs are provided for the School's educational use.
6. Scores are practice estimates
Practice scaled scores, percentiles, and diagnostic bands are the platform's own estimates for instructional use. They are not official ACT or College Board scores and do not predict or guarantee official results.
7. Availability and disclaimers
The Service is provided "as is." The Operator works to keep it available and accurate but does not warrant uninterrupted operation and may modify features with reasonable notice to Schools. Scheduled testing windows should allow for the possibility of technical issues.
8. Limitation of liability
To the maximum extent permitted by law, the Operator's total liability arising out of the Service is limited to the amount the School paid for the Service in the twelve months before the claim, and the Operator is not liable for indirect or consequential damages. Nothing in these terms limits liability that cannot lawfully be limited.
9. Termination
A School may end its use of the Service at any time and may export its data (test content, gradebook, growth reports) beforehand using the built-in export tools. On termination the School's data is deleted on request or per the retention practices in the privacy policy.
10. Changes and contact
Material changes to these terms will be communicated to Schools before taking effect. Questions and notices go to the Operator:
